Requirements

An LLB. For serving prosecutors seeking promotion any appropriate legal qualification. At least eight (8) years post qualification legal experience. Five (5) years’ experience in legal practice will be an added advantage. Demonstrable competency in acting Independently, Professionally, Accountable and with Credibility. Good management skills. Proficiency in prosecution/litigation, competency in guiding investigations and giving instructions in reasonably complex or more difficult common law and statutory offences. Able to draft charge sheets and complex court documents. Ability to act independently without constant supervision. Must have good administrative skills. Prosecutorial/litigation experience in both District and Regional Courts. Required skills include general and strategic management, stakeholder engagement, people management and empowerment, communication, customer focus and responsiveness, problem-solving, decision-making, project management, administration, report writing, service delivery innovation, negotiation, policy analysis and development, research, presentation and facilitation. The applicant must be willing to travel within the DPP division and must possess a valid driver’s licence. The role also requires specifically the ability to manage, guide and train prosecutors; prosecute, guide investigations 74 and issue instructions in reasonably complex or more difficult common law and statutory offences; draft charge sheets and complex court documents; and work independently without constant supervision. General computer literacy and knowledge of programs in Microsoft Office.

Duties

Tutor aspirant prosecutors in an outcomes-based learning programme by guiding practical, theoretical and interactive learning activities. Assess learner competence, conduct and record assessment tasks, monitor progress and provide constructive feedback to learners and programme coordinators. Promote effective study skills, time management, independent learning and confidence in the subject matter. Maintain accurate attendance, progress and session records. Create an inclusive, respectful and safe learning environment that accommodates different learning styles and abilities. Liaise with relevant staff and stakeholders on learner progress, challenges and support needs. Perform related administrative duties and comply with applicable institutional policies, codes of conduct and safeguarding requirements. In addition, manage, supervise, train and mentor prosecutors; study case dockets and determine whether to institute and conduct criminal proceedings, maintenance matters and inquests of a general or more advanced nature in the Lower Courts; prepare matters for court by guiding investigations, consulting witnesses and obtaining additional evidence; draft charge sheets and other court documents; present and assist prosecutors in presenting the State’s case, leading witnesses, conducting cross-examination and addressing the court on conviction, sentence and related matters; and conduct prosecutions on behalf of the State. Perform all incidental and related duties in accordance with applicable legislation, the Code of Conduct, Ethics, the Prosecution Policy and NPA Policy Directives. Prioritise high-impact corruption and other matters; prepare opinions and heads of argument and argue matters in the appropriate court where a right of appearance exists. Conduct performance assessments and assist the Chief Prosecutor with staff assessments. Account to the Chief Prosecutor and the Director of Public Prosecutions as Head of Office. Manage, control and attend to the administration of the Lower Courts and any specific tasks assigned by the supervisor. Advise and assist the relevant Chief Public Prosecutor and/or DPP in identifying training needs, developing strategies to improve NPS performance and coordinating or presenting training interventions. Apply and promote Batho Pele Principles, the Service Charter and NPA processes. Promote partner integration, community involvement and customer satisfaction in collaboration with stakeholders in the criminal justice system. Ensure victim-centred services.
